Chandigarh: The Punjab and Haryana High Court has directed the Central government to consider eunuchs for the government jobs. The High Court gave this directive while hearing a PIL here on Wednesday.

While appreciating the notification issued by the Punjab government, wherein it has prepared a separate category under the head of “transgenders” to consider eunuchs for public employment, the Punjab and Haryana High Court said the transgender people are also entitled for the government jobs.

Punjab is the first state to consider eunuchs for the government jobs following Haryana. In response to the petition filed in the court, Punjab government had said, along with categories for men and women, a separate category would be made for transgenders in the application forms for the state government jobs.

With this, the Punjab government had made clear that the state will create a separate category for transgenders (other than male and female) in application forms offering public employment by Punjab. However, eventually these people, who are selected for the job, will be considered in the category meant for male candidates.

Following this, the Haryana government had also agreed upon considering eunuchs in the category of male candidates for public employment.

The public interest litigation was filed by Kajal Mangal Mukhi, an advocate by profession, who sought directions from the court to allow eunuchs to join government services.

On this, the Central government had argued that impotence cannot be considered a disability; hence eunuchs cannot be given the benefit of reservation. While the Central Personnel Department had submitted that there is no restriction over extension of services to eunuchs in the Central Government jobs.
