I THINK EVERY CITIZEN HAS SOME FUNDAMENTAL RIGHTS TO ADOPT KIDS OR HAVE SARROGATE KIDS.EVEN NORMAL SINGLE PARENTS DOES THAT.PEOPLE WITH GOOD AND BAD INTENTIONS ARE EVERYWHERE.IF THEY'RE ELIGIBLE AND HAS CORRECT PAST RECORD,WHAT IS WRONG IN IT.BUT FEW PEOPLE DO FEEL RIGHTLY,WITH WHICH EVEN I AGREE AND WRITTEN ABOUT IT EARLIER, THAT THEY MAY HAVE TENDENCY TO ABUSE KIDS OF SAME SEX,SO ITS NOT SAFE.

HERE THEY HAVE QUESTION MARK ON THEM.

THINK AND PUT SUBSTAINTIAL CLAUSES TO CHECK AND GUARD THIS ASPECT OF ISSUE.PERSON BELONG TO SUCH COMMUNITY HAVE TO GIVE SUBSTAINIALE PROOF TO CONVINCE THAT IN FAMILY LIFE KIDS WON'T GET ABUSED AND HAD NORMAL LIFE....AS HARMONES CAN GIVE THEM MATERNAL FEELINGS OR 'MAMATAV' IN THEM, BUT THEY CAN NOT BECOME BIOLOGICAL AND NORMAL MOTHER OR PARENTS.!!!....VIBHA)

Amod Kanth, a retired director-general of police and chairman of the Delhi Commission for Protection of Child Rights (DCPCR), which was created under a parliamentary enactment, is in the forefront of a campaign to stop gay couples from the West using “loopholes” in the country’s surrogacy law to acquire babies in India. In a recent

case in New Delhi that got much publicity, a Spanish male gay couple was able to have twins through a surrogate Indian mother and sperm from one of the gay men. The event has drawn the ire of the DCPCR. In an interview to Rashme Sehgal, Mr Kanth says a Supreme Court judgment which allows single gay men and gay couples to be eligible for surrogate parenthood has to be viewed in context.

Q. Is it true that the Spanish male gay couple who had twin girls through the surrogacy method in Delhi earlier this month are on the run and cannot be located?
A. The Spanish gay couple are not found and the police are after them since their case has gained prominence in the media. Hopefully, they will soon be traced and will be questioned regarding the case. The fact of the matter is that India does not allow gay couples to have surrogate babies. In India, marriage between a gay couple continues to be illegal.

Q. The Delhi high court had, in 2009, changed the law in favour of homosexuality?
A. The Delhi high court has done a reading down of 377 IPC which talks about unnatural sex. This category includes men having sex with men, women with women and human beings with animals. A reading down of the law does not mean it has been annulled. I have filed a petition against this in the Supreme Court. I do not think two gays, as a general standard, can look after a child. Children need parents from both sexes. I must emphasise that the law is always a model, it is not an aberration or exception.

Q. As I understand it, the Assisted Reproductive Technologies Regulation Bill (ARTRB) 2010, which has been sent for approval to the Union law ministry, allows a single gay man or woman to have a surrogate baby. In that case what is the problem with a Spanish gay man?
A. When we talk about the subject of marriage, it must be between individuals of two different sexes. That is why we have emphasised in the ARTRB 2010 that while married and unmarried straight couples who live together will be permitted to use surrogate mothers, women must be able to prove that they cannot have a baby naturally.
There is apparently nothing in the bill to stop a single gay man from having a surrogate baby as single men and women will be eligible. But I am opposed to India having emerged as a hot destination for gay couples, and I am in the forefront to ensure that such illegal transactions do not take place.
Dr Anoop Gupta, who runs a popular centre for surrogacy in New Delhi, and the Spanish gay couple will have some explaining to do. This couple had come to India a year ago and had contacted Dr Gupta. But since this adoption law has not been clearly defined, they were taking advantage of the loopholes.
Even in the United Kingdom, single parents do not gain full legal rights over their children born of surrogate mothers. And unlike what is being projected in India, gay marriages are not permitted in most states of the US.

Q. A Supreme Court judgment of 2008, in the case of the Japanese baby Manji Yamada, allows for surrogacy for a single gay man or a male homosexual couple. Is your thinking not at odds with this?
A. The Supreme Court judgment was given in a particular context. I have been saying that the entire issue of surrogacy has to be looked into keeping in mind the Central Adoption Resource Authority (Cara) guidelines and also the child’s rights to parentage. After all, parenthood has a certain definition in India.
I also believe that Supreme Court guidelines can always be re-examined.
The United Nations Convention on the Rights of the Child has also noted that every child has a right to his or her identity as also the right to parentage. A right to parentage means a child is looked after by both mother and father. That rules out gay couples. The Foreign Regional Registration Office (FRRO), which is under the purview of the Union home ministry, has been intimated in the present case, and Dr Gupta and the Spanish gay couple will appear before them.
As Indian laws are yet to approve of a gay marital relationship, the DCPCR shows its grave concern over the issue as to whether the gay foreigner couple have the legal status to be assigned such surrogacy, or have the legal status of adopting parents.
You might perhaps know that a provision in the ARTRB says that prospective foreign parents must have obtained citizenship for their children before bringing them home. Last year, there was the case of an Israeli gay man stranded in India for two months with his twin sons because Israel’s interior ministry refused to issue a paternity test, which is required for the recognition of all children born abroad.
